This End-User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) and the developer of Flowt (“Flowt”, “we”, “us”, or “our”) for the Flowt browser extension, including any updates we provide (“the Software”). By installing or using the Software, you agree to be bound by this EULA and by the Flowt Privacy Policy, which forms part of it. If you do not agree, do not install or use the Software.
If you are under the age of majority where you live, you may use the Software only with the consent of a parent or legal guardian, who agrees to this EULA on your behalf.
The Software is provided free of charge. We grant you a revocable, personal, non-exclusive, non-transferable, non-sublicensable, limited license to download, install, and use the Software on any device that you own or control, for your own use (including at work), in accordance with this EULA. All rights not expressly granted to you are reserved by us.
You agree not to, and you will not permit others to:
Redistribute or Commercially Exploit: Sell, license, sublicense, rent, lease, assign, distribute, publish, host, or otherwise commercially exploit the Software, or make the Software available to any third party, except by directing them to the official listing from which they can install it themselves.
Modify or Reverse Engineer: Modify, create derivative works of, disassemble, decompile, or reverse engineer any part of the Software, or publish a modified copy of it, except to the extent that applicable law expressly permits this despite this restriction.
Misrepresent the Software: Remove, alter, or obscure any copyright or other proprietary notice, or present the Software, or any copy or modified version of it, as your own or as an official version.
Use for Unlawful Purposes: Use the Software for any purpose that is illegal or prohibited by this EULA.
The Software, including its code, design, name, and logo, is protected by copyright and other intellectual property laws. All right, title, and interest in and to the Software are and shall remain our sole and exclusive property. This EULA does not grant you any ownership rights to the Software, or any right to use the Flowt name or logo, but only a limited license to use the Software.
Flowt is an independent project. It is not affiliated with, endorsed by, sponsored by, or in any way officially connected with YouTube, Google LLC, or any of their affiliates. “YouTube”, “Chrome”, and “Google” are trademarks of Google LLC, used here only to describe what the Software works with.
The Software only changes how YouTube pages are displayed in your own browser. It does not give you any rights to YouTube content or services. You remain solely responsible for complying with YouTube’s and Google’s terms of service when you use them. YouTube can change its website at any time, which may cause some or all features of the Software to stop working, temporarily or permanently.
The Software is a personal self-control and focus tool. It is not a security product, a parental-control product, or a content filter for protecting children, and it must not be relied on for any of those purposes. In particular:
You are responsible for deciding whether the Software is suitable for your needs.
We may, at any time and without notice or liability, update, change, suspend, or discontinue the Software or any of its features, and we are under no obligation to provide updates, maintenance, or support.
We may revise this EULA from time to time. The current version will always be published at this address with its effective date. Your continued use of the Software after a revised version takes effect means you accept it. If you do not agree to a revised version, uninstall the Software.
If you send us suggestions, feature requests, bug reports, or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use it for any purpose, without any obligation or compensation to you. Please do not include confidential or personal information in feedback.
THE SOFTWARE IS PROVIDED FREE OF CHARGE, “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND DEFECTS, AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE SOFTWARE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND WARRANTIES THAT MAY ARISE OUT OF COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE, OR TRADE PRACTICE.
WITHOUT LIMITATION TO THE FOREGOING, WE PROVIDE NO WARRANTY OR UNDERTAKING, AND MAKE NO REPRESENTATION OF ANY KIND, THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, ACHIEVE ANY INTENDED RESULTS (INCLUDING REDUCING DISTRACTION OR SCREEN TIME), HIDE OR BLOCK ANY PARTICULAR CONTENT, BE COMPATIBLE OR WORK WITH ANY OTHER SOFTWARE, WEBSITE (INCLUDING YOUTUBE), BROWSER, SYSTEM, OR SERVICE, OPERATE WITHOUT INTERRUPTION, MEET ANY PERFORMANCE OR RELIABILITY STANDARDS, BE SECURE OR ERROR-FREE, OR THAT ANY ERRORS OR DEFECTS CAN OR WILL BE CORRECTED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, DATA, SETTINGS, USE, TIME, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SOFTWARE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS OF ANY KIND ARISING OUT OF OR RELATING TO THE SOFTWARE OR THIS EULA, TAKEN TOGETHER, SHALL NOT EXCEED FIVE UNITED STATES DOLLARS (US$5). THIS LIMIT APPLIES EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
YOU ACKNOWLEDGE THAT THE SOFTWARE IS PROVIDED FREE OF CHARGE, AND THAT THE DISCLAIMERS IN SECTION 8 AND THE LIMITATIONS IN THIS SECTION 9 ARE AN ESSENTIAL BASIS OF THIS EULA, WITHOUT WHICH THE SOFTWARE WOULD NOT BE PROVIDED.
Some countries, states, and provinces do not allow certain warranties to be excluded or certain liabilities to be limited. In those places, the exclusions and limitations in this EULA apply to the fullest extent the law permits, and our liability is limited to the smallest amount the law allows. Nothing in this EULA excludes or limits any liability that cannot be excluded or limited under applicable law, such as liability for fraud, or for death or personal injury caused by negligence. Nothing in this EULA affects any mandatory consumer rights you have under the law of the country where you live.
This EULA is effective until terminated. You may terminate it at any time by uninstalling the Software. Your rights under this EULA will terminate automatically, without notice from us, if you fail to comply with any of its terms. Upon termination, you must stop using the Software and uninstall it and any copies of it. Sections 3, 4, 7, 8, 9, 10, 12, and 13 survive termination.
This EULA and your use of the Software are governed by the laws of India, without regard to its conflict of law principles. Before starting any legal proceedings, you agree to first contact us at the address below and try in good faith to resolve the matter informally for at least 30 days.
Subject to the last sentence of this section, any legal action or proceeding arising under this EULA will be brought exclusively in the courts located in Uttar Pradesh, India, and the parties consent to the personal jurisdiction and venue of those courts. To the extent permitted by applicable law, you may bring claims only on your own behalf, and not as a plaintiff or class member in any class, collective, or representative action. If you are a consumer and the mandatory law of your country of residence gives you the right to bring proceedings in your local courts, or to the protection of its consumer laws, this section does not take that right away.
If you have any questions about this EULA, please contact us at contact.flowt@gmail.com.
